On Tuesday, I reported how Ketanji Brown Jackson got into trouble when Sen. Ted Cruz (R-TX) pointed out some of the problems in her testimony regarding Critical Race Theory (CRT). Sen. Josh Hawley (R-MO) raised questions about lax sentences for child porn offenders, and the White House stepped in it big time when they came rushing to her defense and attacked him.
But there was another very simple question that Jackson was asked on Tuesday to which she refused to provide an answer. Sen. Marsha Blackburn (R-TN) was asking questions about gender issues and asked Jackson if she could define the word “woman.”

JACKSON: "No, I can't"

Blackburn then turned to quote the late Supreme Court Justice Ruth Bader Ginsburg, who wrote the majority opinion in U.S. v. Virginia (1996), in which the Court struck down Virginia Military Institute’s male-only admissions policy.
“Supposed inherent differences are no longer accepted as a ground for race or national origin classifications,” Blackburn said, quoting Ginsburg. “Physical differences, between men and women, however, are enduring. The two sexes are not fungible. A community made up exclusively of one sex is different from a community composed of both.”
“Do you agree with Justice Ginsburg that there are physical differences between men and women that are enduring?” the senator asked.
“Um, senator, respectfully I am not familiar with that particular quote or case, so it’s hard for me to comment,” the judge responded.
“Do you interpret Justice Ginsburg’s meaning of men and women as male and female?” Blackburn pressed. Jackson did not comment on the matter.
“Can you provide a definition for the word ‘woman?’” the senator asked.
“Can I provide a definition? No,” Jackson responded. “I can’t.”
“You can’t?” Blackburn asked.
“Not in this context, I’m not a biologist,” the judge replied.
Well, that’s a problem. Since when do you need to be a biologist to be able to define what a woman is?
So you have someone who the Democrats have proposed as a ground-breaking woman, but she refuses to define what a woman even is? How did Biden know to pick her as a woman — what did he base that decision on? How does she stand up for women’s rights if she can’t even define what a woman is?
Republicans who are trying to plumb just how left she is got more than a little help with that answer as the refusal to answer that question screams leftist ideology. Although we have to note that even her seemingly wanting to be in keeping with the leftist orthodoxy on gender, she still made a mistake that might trigger them anyway. Isn’t gender a social construct or how you choose to identify? Or did she just admit it was a matter of biology?
