Federal Judge Plunges Dagger Into Democrats’ Open Borders Agenda And Twists It Slowly

A federal judge just gave President Joe Biden and his merry band of open borders advocates some not-so-good news. The president’s effort to prevent the authorities from deporting illegals residing in the country has been dealt a devastating blow.

Fox News reported, “U.S. District Judge Drew Tipton indefinitely banned enforcement of the Jan. 20 memorandum that would have implemented a 100-day moratorium on most deportations.”

Prior to this ruling, the judge had imposed a two-week restraining order on the measure after Texas Attorney General Ken Paxton argued that it was a violation of federal law as the Biden administration did not consult with Texas before taking such an action. Due to an agreement with the Department of Homeland Security (DHS), the administration is supposed to check in with the Lone Star state before issuing this type of order.

On the campaign trail, Biden touted his plan to institute the 100-day pause as a part of his massive immigration agenda that also includes the cessation of border wall construction, ending the Migrant Protection Protocols (MPP), and providing a pathway to citizenship for over 11 million illegal immigrants. Biden’s deportation moratorium was seemingly designed to safeguard individuals residing in the U.S. in violation of immigration laws, but it did have some exceptions.

Fox News noted:

It would exclude those who, according to a written finding by the head of Immigration and Customs Enforcement (ICE), have engaged in terrorism or espionage or who pose a danger to national security. It would also exclude those who were not present in the U.S. before Nov. 1, 2020, those who agreed to waive the right to remain, and those whom the ICE director individually determined need to be removed by law.

The agreement between Texas and DHS was struck during the final days of the Trump administration – likely to pre-empt Biden’s eventual effort to protect illegal aliens. The contract requires DHS to provide Texas with 180 days’ notice of any proposal regarding the reduction of immigration enforcement.

“Our state defends the largest section of the southern border in the nation. Failure to properly enforce the law will directly and immediately endanger our citizens and law enforcement personnel,” Paxton said in a statement released as he filed the lawsuit.

The moratorium was ostensibly intended to last for three months until DHS could provide further guidance. But it seems likely that the Biden administration would have created reasons to extend it given the fact that it is pursuing a distinctly open borders approach to immigration.

Judge Tipton’s decision provided a difficult setback for President Biden. But the battle over the border will still continue, especially when it concerns the administration’s push to admit as many legal and illegal immigrants as possible to give the Democrats an electoral advantage. Biden’s immigration agenda is a comprehensive set of polices designed to encourage and increased legal and illegal immigration. But if the judge’s decision is any indication, it may not be as easy for him to implement it as he thought.
