United States District Court Judge Robert R. Summerhays blocked an effort by the Biden administration to end Title 42 on Monday, which would have likely resulted in a rapid increase of migrant encounters at the southern border.
And just a few weeks ago, U.S. District Court Judge Kathryn Kimball Mizelle scrapped the Centers for Disease Control’s federal transportation mask mandate, and now Americans can go mask free on planes, trains, airports, and more–if they choose to do so.
What both of these federal judges have in common is that they were appointed under the Trump administration, which Rolling Stone and other outlets have griped about. While one can argue all day about the nuances of the previous presidency, it is indisputable that his judicial appointments will solidify his legacy and make a significant impact for years to come.
Title 42 is one of the few tools in law enforcement’s toolbox to keep the border from being more of a disaster, RedState’s Bonchie noted Friday, and the mask mandates were unnecessary for the current point of the pandemic. These judges thankfully did their jobs and examined the current situation, and they determined that the executive branch overstepped its bounds.
Unfortunately, people like Summerhays and Mizelle are some of the only blockades in Washington at the moment to truly protect the United States from the full-blown Biden agenda. The reality of that may change in November if Republicans retake the congressional majority, but complacency is a killer and who knows if this fresh batch of lawmakers will actually take charge.
For now, Republicans are stuck in the minority and left begging Sens. Joe Manchin (D-W. Va.) and Krysten Sinema (D-Ariz.) to not cave to their party’s demands on occasion. Their stubbornness in protecting the filibuster has kept numerous pieces of legislation from making it through the Senate, and they certainly deserve credit for that. Still, they are Democrats, and the consequences from their own party could result in some bending on their end, which does not make them a good safety net. When they might support the policies at hand but not the processes, it raises obvious questions and should encourage Republicans to mobilize on the campaign trail.
As his approval ratings continue to sink, RealClearPolitics shows, it’s an open secret that Biden’s presidency has been a complete failure, and the administration’s only been in office for a year-and-a- half. The issues will keep piling up, so there need to be more people at the federal level shouting “STOP” when his White House goes too far. Many local and state governments have been effective at countering them as well, especially when attorney generals decide to sue the administration, but they can only do so much.
Americans deserve better than what they’re getting right now, and conservatives should be grateful for the few people in the judicial and legislative branches still working to truly improve America.
